Shipping and Returns Policy
Shipping to other Countries is Not Available. Presently we only ship within the United States and not to any other Country or Territory. We hope to remedy that soon.
1. Order Acceptance and Cancellation
We reserve the right at any time after receipt of your order to accept, decline, or limit your order for any reason, whether or not your credit card has been charged. If your credit card has been charged and your order is canceled you will receive a prompt refund credit to your account.
Once an order has been placed, it cannot be canceled if it has been shipped. If order still in process, we will do our best to cancel the order if requested.
We make every effort to maintain the availability of our site. However, should we experience technical difficulties, we are not responsible for orders that are not processed or accepted.
2. Payment Terms and Sales Taxes
Terms of payment are within our sole discretion and, unless otherwise agreed by us in writing, payment must be received by us prior to our acceptance of an order.
We accept Visa, MasterCard, Discover, American Express, PayPal balance for all purchases. You represent and warrant that (a) the credit card information you supply is true, correct and complete, (b) charges incurred by you will be honored by your credit card company, and (c) you will pay charges incurred by you at the posted prices, including all applicable taxes, if any. PayPal will be processing all orders and we will not have access to your Credit Card or Bank information.
By law we are required to collect Sales Tax for the State of Massachusetts on products delivered or billed to a Massachusetts address at the then current rate, which is now at 6.25%, of the cost of goods not including shipping.
All payments must be in United States dollars. Current billing addresses and phone information must be included with every order. Charges for shipping and handling will be made in accordance with our then current shipping policies, as described below.
Credit Card Charges. Your credit card will be charged when you place your order. If we are not able to fulfill your order for any reason your credit card will be refunded.
3. Changes in Products and Pricing
We make every effort to ensure that the items you see on our site are accurately priced. Despite our best efforts, however, items on our site may occasionally be mislabeled. In the event a product is listed at an incorrect price due to typographical, photographic, technical, or other error, Cape Cod Jewelry shall have the right to refuse any sale at the incorrect price. We reserve the right to refuse or cancel any orders for product listed at an incorrect price.
If an item’s correct price is lower than our stated or scanned price, we will charge the lower amount and ship you the item. If an item’s correct price is higher than our stated price, we may at our option ship it to you at the lower incorrect price or we will cancel your transaction and notify you of the price error and cancellation. You will, of course, have an opportunity to purchase the item at the correct price, if you so wish or we shall promptly issue a refund to your method of payment.
Certain discounts may be available when shopping at Cape Cod Jewelry. If you have a promotion code or coupon code, you may enter it when checking out to receive the discount. Discounts may never be combined with other discounts. However Gift Cards and Store Credit coupons can be used with promotional coupons.
All pricing for the products available on our site is subject to change. For all of our prices and products, we reserve the right to make adjustments due to changing market conditions, product discontinuation, manufacturer price changes, errors in advertisements and other extenuating circumstances.
4. Shipping Policy
We will do our best to ship the order within 24 hours during working days or sooner if possible, after receiving notification that your order is paid and cleared for shipping. The posted shipping time frame is contingent upon credit card approval and may be delayed should we experience difficulties in obtaining authorization.
There may be occasional delays beyond the posted order processing time. If the delay is more than ten (10) business days, we will send you an email message notifying you of the delay.
Back orders. If an item goes on back order we will ship you the part of your order that is in stock. When the item becomes available we will ship you the rest of your order.
Order tracking. If a tracking number is provided by the shipping carrier, we will update your order with the tracking information. Please note that some orders using 1st Class USPS mail will not have tracking numbers.
These shipping terms are accepted by you by placing an order with us.
5. Advertising Disclaimer and Trademarks
The descriptions of products that are posted on our site are our best representations.
In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received input by us or from our suppliers, we shall have the right to refuse or cancel any orders placed for products listed at the incorrect price. We shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, we will immediately issue a credit to your credit card account in the amount of the charge.
All trademarks and registered trademarks relating to products and services available through our site are the sole property of their respective owners. Photographs are the property of Cape Cod Jewelry and may not be used or reproduced without out written permission except for use in Social sites such as Pinterest, Facebook and others.
6. Disclaimer and Limitation of Liability
THIS LIMITATION. Except as otherwise detailed herein below, our responsibility for defects relating to the products available on our site is limited to the procedures described in our return policy set forth below. WE DO NOT ACCEPT LIABILITY BEYOND THE REMEDIES SET FORTH HEREIN.
OUR SOLE AND ENTIRE MAXIMUM LIABILITY (AND THE LIABILITY OF ANY OF THE PROVIDERS OF PRODUCTS AVAILABLE ON OUR SITE), FOR ANY REASON, AND YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY CAUSE WHATSOEVER, SHALL BE LIMITED TO THE ACTUAL AMOUNT PAID BY YOU FOR THE PRODUCTS YOU HAVE ORDERED THROUGH OUR SITE.
SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN DAMAGES, SO THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU TO THE EXTENT SUCH JURISDICTION’S LAW IS APPLICABLE TO YOUR PURCHASE OF PRODUCTS.
7. Warranty and Return Policy
It is our desire to ensure that every product under warranty performs to its specifications. We offer a fifteen (15) day or 30 days return policy from date of shipping on all items based on our Warranty policy.
To return products, you must email our Customer Care at Customer-Care@capecodjewelry.net to obtain a Return Merchandise Authorization (RMA) number before shipping your product. NO returns of any type will be accepted without an RMA number. Please send us the following information when emailing us for an RMA number: customer name, invoice or order number, SKU number, and nature of the problem.
To expedite the processing of your refund or credit, we ask that products be returned within ten (7) days of the date that we issue the RMA. All returned products MUST be 100% complete, contain ALL original boxes and packing materials and not have been worn or used otherwise. You are responsible for shipping charges on returned items. You must insure the shipment or accept the risk of loss or damage during shipment. We strongly recommend that you fully insure your return shipment against loss or damage and that you use a carrier that can provide you with proof of delivery for your protection.
If your order arrives in a damaged condition, save the merchandise AND the original box and packing it arrived in, and notify us immediately to arrange for a carrier inspection and a pickup of the damaged merchandise.
To Return An Item. Your item must be in its original unused condition to be returned, unless there is a manufacturer defect.
Restrictions do apply. NONDEFECTIVE returns can be accepted directly by us within fifteen (15) days from the shipping date for, at our discretion, credit or exchange. All NONDEFECTIVE returns are subject to a 25% restocking fee or up to 50% if not in resalable condition, waivable by us at our discretion. Customer damaged items are not returnable but we may exchange them. See our FAQs and Warranty page for current info on this policy.
These policies set forth your sole and exclusive rights with respect to return of products and services that you may purchase through our site.

9. Forces Outside of our Control
In addition to any excuse provided by applicable law, we shall be excused from liability for non delivery or delay in delivery of products available through our site arising from any event beyond our reasonable control, whether or not foreseeable by either party, including but not limited to, labor disturbance, war, fire, accident, act of God, adverse weather, inability to secure transportation, governmental act or regulation, and other causes or events beyond our reasonable control, whether or not similar to those which are enumerated above.
10. Governing Law and Statute of Limitations
This site (excluding linked site) is controlled by us from our offices within the State of Massachusetts, United States of America. It can be accessed from all 50 states, as well as from other countries around the world. As each of these places has laws that may differ from those of Massachusetts, by accessing this site both of us agree that the statutes and laws of the State of Massachusetts, without regard to the conflicts of laws principles thereof, will apply to all matters relating to the use of this site and the purchase of products and services available through this site.
